Personal data processing statement

SYSTEMTUBE s.r.o. (hereinafter „SYSTEMTUBE“) collects, processes and uses personal data in compliance with the Regulation of 27th April 2016 of the European Parliament and of the Council (EU) No. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and with Act No. 18/2018 Coll. on personal data protection and does everything that is necessary to ensure the compliance with the legal regulations given.

SYSTEMTUBE will only process personal data for the purpose for which it was acquired. Systemtube hereby declares that it will process personal data only in accordance with good manners and will act so as not to be in conflict with the act on personal data protection or any other generally binding legal regulations and will not evade the regulations in question. Once personal data is processed for the purpose given, the controller shall proceed with personal data elimination without delay unless a special act requires otherwise.

Systemtube will arrange for the relevant level of personal data protection and will protect the personal data being processed against their damage, destruction, loss, modification, illegal access to it and against making such data accessible, provided or available to public and any other illegal forms of processing and, for the purpose given, Systemtube has adopted appropriate safety measures corresponding to the method of personal data protection.

Systemtube will process personal data in accordance with the data subject’s rights. The data subject is entitled to have it confirmed by Systemtube that their personal data related to them has been processed. If Systemtube processes such personal data, the data subject is entitled to get access to the personal data given and the information on:

• Purpose of personal data processing;
• Category of personal data processed;
• Identification of the recipient or the category of the recipient to whom the personal data has been or is supposed to be provided, especially a recipient in a third country or a multinational if possible;
• Period for which the personal data will be kept; should it be impossible, information on the criteria for its specification;
• Right to request the correction or erasure of personal data or restriction of processing of personal data concerning the data subject by Systemtube, or the right to object to the processing of such personal data;
• Right to initiate proceedings
• Source of personal data, if the personal data has not been collected from the data subject;
• Existence of automated individual decision-making, profiling included.

Quotation request

The provided personal data will be used for the provision of a quotation. Once the personal data is processed for the purpose given, SYSTEMTUBE shall proceed with personal data elimination without delay. Systemtube hereby declares that it will arrange for a relevant level of personal data protection, will process personal data only in accordance with good manners and will act so as not to be in conflict with the act on personal data protection or any other generally binding legal regulations and will not evade the regulations in question.

Rights of personal data providers:

• The consent to personal data processing may be withdrawn by the requester any time free of charge by writing to the following address: SYSTEMTUBE, Južná trieda 8, 040 01 Košice or mickova@systemtube.sk.
• The requester is entitled to ask SYSTEMTUBE for the access to their personal data and to have it corrected or deleted, to have such data processing limited or to refuse its processing as well as to have such data transferred.
• The requester is entitled to uphold their rights through a responsible person or by lodging a motion for investigation or a complaint with a supervisory body, in Slovakia it is the Personal Data Protection Authority within the meaning of Section 100 of Act No.: 18/2018 Coll.

I hereby give my consent to SYSTEMTUBE to process and keep my personal data for any relevant changes in the quotation or for contacting me in the future. The period for which personal data is kept shall be 2 years.

• The Provider is entitled to ask SYSTEMTUBE for the access to their personal data and to have it corrected or deleted, to have such data processing limited or to refuse its processing as well as to have such data transferred.
• The requester is entitled to uphold their rights through a responsible person or by lodging a motion for investigation or a complaint with a supervisory body, in Slovakia it is the Personal Data Protection Authority within the meaning of Section 100 of Act No.: 18/2018 Coll.

I am of less than 16 years of age and my parent, the bearer of parental rights and obligations, agrees with my personal data processing.
I am of more than 16 years of age.

The data subject is entitled to have the personal data related to them corrected by SYSTEMTUBE without delay. With regard to the purpose of personal data processing, the data subject shall have the right to have incomplete personal data completed.

The data subject is entitled to have the personal data related to them erased by SYSTEMTUBE without delay, if:

• Personal data is no longer necessary for the purpose for which it was collected or otherwise processed;
• Data subject withdraws their consent on which the processing is based, and there is no other legal ground for such personal data processing;
• Data subject objects to the processing and there are no overriding legitimate grounds for the processing;
• Personal data is processed unlawfully.

The data subject shall have the right to restricted personal data processing by SYSTEMTUBE if:

• Accuracy of the personal data is contested by the data subject in the period enabling the controller to verify the accuracy of the personal data given;
• Personal data processing is unlawful and the data subject objects to the erasure of the personal data and requests the restriction of its use instead;
• Controller no longer needs the personal data for the purposes of its processing, but it is needed by the data subject for the exercise of their legal claim; or
• Data subject objects to their personal data processing.

The data subject shall have the right to receive the personal data related to them and provided to the controller in a structured, commonly used and machine-readable format and to transfer the personal data given onto another controller, if technically feasible. The right of transferability does not apply to the processing of the personal data necessary for the performance of a task carried out in the public interest or in the exercise of official powers vested in Systemtube as a controller.

On grounds relating to their particular situation, the data subject shall have the right to object to the processing of the personal data related to them within the framework of the controller’s legitimate interest, profiling based on these provisions included. The controller shall no longer process the personal data unless they can demonstrate compelling legitimate grounds for personal data processing which override the rights, interests and freedoms of the data subject, or the grounds for the exercise of a legal claim.

The data subject shall have the right to object any time to the processing of the personal data related to them for direct marketing purposes, including profiling to the extent to which it is related to direct marketing. If the data subject objects to their personal data processing for direct marketing purposes, the controller will no longer process the personal data for these purposes.

The data subject shall have the right not to be subject to a decision based solely on automated personal data processing, profiling included, and having legal effects in relation to the data subject or similarly significantly affects such a subject, in so far as it does not concern the personal data necessary for entering into a contract or for the performance of a contract between the data subject and the controller.

The data subject has the right to initiate an investigation within the meaning of Section 100 of Act No.: 18/2018 Coll. on personal data protection if they suspect that their personal data has been handled unlawfully or if the processing of their personal data or the breach of the safety of the processing has violated their rights.

Under the conditions laid down by a special regulation or an international treaty binding the Slovak Republic, SYSTEMTUBE or the controller may limit the scope of rights and obligations if such limitation is provided for in order to ensure:

• • Security of Slovak Republic;
  • Protection of Slovak Republic;
  • Public order;
  • Meeting tasks for the purposes of criminal proceedings;
  • Other important objectives of general public interest of the European Union or of the Slovak Republic, in particular an important economic or financial interest of the European Union or of the Slovak Republic, including monetary, budgetary and tax matters, public health or social security;
  • Protecting the independence of the judiciary and judicial proceedings;
  • Prevention of ethical violations in regulated professions or regulated professional activities;
  • Monitoring, control or regulatory function connected with the exercise of public authority;
  • Protection of the rights of the data subject or of other persons;
  • Assertion of a legal claim;
  • Economic mobilisation.

The data subject is entitled to uphold their rights through a responsible person or by lodging a motion for investigation or a complaint with a supervisory body, in Slovakia it is the Personal Data Protection Authority within the meaning of Section 100 of Act No.: 18/2018 Coll.
